Legal Process

This is a general guide and not intended as legal advice.

Pre-filing:

We begin to gather all the necessary documents to get ready before we file a lawsuit.

 

Filing:

We fill out the required court paperwork to start a Court action.  After filing the papers, they are submitted to a process server for proof of service.  There is a waiting period which is required by law for the other person to either answer the complaint or default.

 

Discovery:

This period begins 30 days after the other consumer answers the complaint. This is when Lien Enforcement, Inc and the consumer or business exchange information and learn about the strengths and weaknesses of each side’s case.

 

Pretrial:

If settlement is not achieved outside of court action, pretrial will scheduled about 90 days before the trial date. This is when Lien Enforcement, Inc. will begin preparing for the trial.  We will also make decisions regarding the need for a settlement conference with the judge as well as other remedies.

 

Trial:

Trials can be resolved in 1 day or take many months. It generally depends on how complicated the case is for the facts to be presented and the judge to make a ruling.

 

Post-Trial:

After the trial, assuming favorable award Lien Enforcement, Inc will begin the collection of your judgment.  Upon unfavorable outcome we will review our possibilities for an appeal to a higher court for ruling.
